These Terms of Service (“Terms”) govern your use of the website located at www.sportsguidebooks.com (the “Site”) and the purchase of sports magazines sold through the Site (the “Service”), operated by SureShot Books Publishing LLC (“Company,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to be bound by these Terms in their entirety. If you do not agree, do not use this Site or purchase from it.

1. About This Service

Sports Guide Books is a magazine subscription and single-copy sales service operated by SureShot Books Publishing LLC. We specialize in delivering sports-related publications to individuals who are incarcerated in correctional facilities throughout the United States.

Because our products are shipped directly to correctional facilities, our service operates under unique conditions that differ from standard retail. Facility rules, regulations, and approved vendor lists govern whether any given magazine can be delivered to any given recipient. It is the sole responsibility of the purchaser to confirm delivery eligibility before placing an order.

2. Customer Responsibility — Facility Verification

Before completing any purchase, you are responsible for confirming:

• The receiving facility accepts incoming magazines from outside vendors
• The specific title(s) you are ordering are permitted at that facility
• The inmate/receiver’s name and ID number are spelled and formatted exactly as required by the facility
• The facility’s current mailing address and any special delivery instructions
• Whether the facility requires subscriptions to come only from approved publishers

We are not responsible for magazines that are rejected, confiscated, returned, or destroyed by a correctional facility for any reason, including but not limited to facility policy changes, lockdowns, transfers of the inmate, or administrative holds.

3. All Sales Are Final — No Refund Policy

By completing a purchase on this Site, you expressly acknowledge and agree that:

• You have read and understood this no-refund policy in full
• You have verified with the receiving facility that the magazine(s) ordered will be accepted
• You accept all risk of non-delivery for reasons related to facility policy or inmate status
• You waive any right to a refund or chargeback based on non-delivery due to the above circumstances

4. Order Accuracy

You are solely responsible for providing accurate and complete order information, including:

• Full legal name of the inmate/receiver exactly as it appears in facility records
• Correct inmate identification number
• Correct facility name and mailing address
• Your own valid billing address and contact information

We are not liable for non-delivery caused by inaccurate or incomplete order information. Orders submitted with incorrect information will not be eligible for a refund or re-shipment at no charge.

5. Payment & Billing

We accept major credit and debit cards processed through Stripe. All transactions are processed in U.S. dollars. By submitting payment, you represent that you are the authorized user of the payment method and that the billing information provided is accurate.

6. Shipping & Delivery

Orders are typically processed and shipped within 3–7 business days of order placement. Delivery times vary based on USPS transit times and facility mailroom processing, which can add several additional weeks. We are not responsible for USPS delays, facility mailroom processing times, or mail holds resulting from facility operations.

Tracking information, where available, will be provided to the email address you supply at checkout. Title and risk of loss pass to the buyer upon our tender of the shipment to USPS.

7. Subscription Orders

Where magazine subscriptions are offered, your subscription will renew automatically at the stated interval unless you cancel before the renewal date. You may cancel a subscription by contacting us at info@sureshotbooks.com. Cancellations take effect for future billing periods only; no refund will be issued for any already-billed period or for issues already in transit or delivered.

8. Prohibited Uses

You agree not to use this Site to:

• Provide false or misleading order information
• Attempt to circumvent any facility’s approved-vendor restrictions
• Engage in unauthorized commercial resale of publications
• Violate any applicable federal, state, or local law
• Initiate a chargeback in bad faith after having agreed to these Terms

9. Intellectual Property

All content on this Site — including text, graphics, logos, and images — is the property of SureShot Books Publishing LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Disclaimer of Warranties

THIS SITE AND ALL PRODUCTS SOLD THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY MAGAZINE WILL BE ACCEPTED BY ANY CORRECTIONAL FACILITY.

11. Limitation of Liability

IN NO EVENT SHALL SURESHOT BOOKS PUBLISHING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THIS SITE OR PURCHASE OF ANY PRODUCT, INCLUDING BUT NOT LIMITED TO DAMAGES FOR NON-DELIVERY DUE TO FACILITY REJECTION OR INMATE RELOCATION. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless SureShot Books Publishing LLC and its affiliates from any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your provision of inaccurate order information; or (d) any chargeback or dispute you initiate in bad faith.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising under these Terms shall first be submitted to good-faith negotiation. If unresolved, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in Rockland County, New York. You waive any right to a jury trial or class action.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
